Judge drops one injunction against Robert E. Lee statue removal

(RICHMOND, Va.) — The legal battle over the future of the Robert E. Lee statue in Richmond, Virginia, had two major developments on Monday.

Judge W. Reilly Merchant dismissed a case filed by one resident who is blocking Gov. Ralph Northam’s June 4 order to remove the statue from Monument Avenue. He also granted an injunction on a second suit that’s aiming to keep the Confederate statue in place.

In the first case, the resident, who is a great-grandson of one of the statue’s land donors, contended that the state didn’t have the legal authority to remove the statue of the Confederate leader. Judge Merchant ruled the plaintiff’s claims “fail as a matter of law.”

“The plaintiff has articulated no substantial legal right sufficient for the court to create a declaratory judgment,” Merchant wrote in his ruling.

Meanwhile, another lawsuit filed against Northam’s order continues to play out in the courts. Merchant ordered a 90-day injunction on Monday against the removal while residents of Monument Avenue make their case against the governor’s order.

“The fact obviates the need for the court to address the remaining…counts,” the judge’s order said.

A spokeswoman for Virginia Attorney General Mark Herring’s office said in a statement that he filed a motion to dismiss that suit.

“Attorney General Herring remains committed to ensuring this divisive, antiquated relic is removed as soon as possible,” the spokeswoman said in a statement.

The statue’s removal is among the monuments to Confederate leaders that have come under extra scrutiny following the Black Lives Matter protests. Statues and other monuments around Virginia have been removed over the last few months, including busts from inside the state Capitol.

A descendant of Robert E. Lee told ABC News he supports the removal, calling it a “no-brainer.” And Lee himself opposed statues to Confederate leaders. “I think it wiser,” he wrote in 1869, “…not to keep open the sores of war but to follow the examples of those nations who endeavored to obliterate the marks of civil strife, to commit to oblivion the feelings engendered.”

The statue’s opponents have held rallies outside the statue since the end of May and on several occasions projected images of Black figures, including the late Rep. John Lewis, on the statue to decry racism.

The movie — called The Christmas Set Up — will follow Hugo, a New York corporate lawyer who goes home to Milwaukee for the holidays and runs into his secret high school crush, Patrick.

The network’s annual slate of holiday films will also include A Sugar & Spice Holiday, which centers on a Chinese-American family; Christmas Ever After, starring Tony winner Ali Stroker; Christmas Unwrapped, produced by Tiffany Haddish; and Dear Christmas, starring Melissa Joan Hart and Jason Priestly.

The full “It’s a Wonderful Lifetime” movie slate will be released in September.

Last month, Lifetime’s Christmas movie competitor, Hallmark Channel, announced part of its original holiday movie lineup and was criticized for its lack of LGBTQ representation. Following the criticism, Hallmark announced its commitment to diversity and promised upcoming films would contain LGBTQ storylines.

Carly Pearce shares vulnerability while recording new song: "I’m learning to love myself and my story"

Disney Channel/Image Group LACarly Pearce has learned a valuable lesson during this quarantine-stricken year — to embrace imperfection.

In an honest Instagram post, Carly opens up about how she’s often tried to live through the lens of perfection, but has learned to accept life’s imperfections, leading to self-love.

“This season of life has shown me that we will never be perfect. NEVER. We have to find beauty in the imperfections and in the things that life throws at us,” she explains. “I am owning my version of ‘imperfection’ & in return, feel like I’m learning to love myself and my story on such a deeper level.”

Part of this revelation comes with her new song, “Show Me Around.” After debuting the song during an appearance on the Grand Ole Opry in June, Carly recently recorded an official version of the track, which she shared alongside the thoughtful caption.

The video shows her singing a raw vocal cut of the song in the recording booth, marking the first time she’s taken fans inside the studio with her in such an intimate way.

Carly wrote “Show Me Around” in honor of late songwriter and producer busbee, who passed away from a rare form of brain cancer in 2019. Busbee produced Carly’s 2017 debut album, Every Little Thing, and self-titled sophomore album, released in February.

“I am so very proud of this song that I wrote for my late producer @busbee & he was always such a big believer in me being ‘okay with not being perfect.’ I felt that message ringing so true in the studio & felt him there as I sang this vocal,” she remarks.

Carly experienced another major life change this year when she announced that she and Michael Ray were divorcing after eight months of marriage.
