Assault charges dropped against Buffalo police officers seen pushing protester

(BUFFALO, N.Y.) — Assault charges against two Buffalo, New York, police officers seen in a video shoving a 75-year-old man to the ground during a protest last year have been dropped, prosecutors announced Thursday.

Officers Aaron Torgalski and Robert McCabe faced felony assault charges over the June 4 incident at Niagara Square. In the video, protester Martin Gugino is seen walking in the direction of the officers before they are seen pushing him. Gugino fell flat onto his back and bumped the back of his head on the concrete, video shows.

The grand jury voted to “no bill” the case, ultimately dismissing the charges, Erie County District Attorney John Flynn said during a press briefing Thursday.

Flynn defended his decision to bring charges against the officers.

“To this day, I’ll stand by the fact that charges should have been charged, and there was probable cause at that time to charge that offense, and I stand by that,” Flynn said. “I make no apologies for it.”

The grand jury proceedings are sealed and Flynn was unable to elaborate on what happened, but he said prosecutors “put all relevant evidence” before the grand jury, including multiple witnesses.

“I sandbagged nothing,” he said. “You have my word on that.”

Both officers, who were suspended after the incident, entered not guilty pleas during their arraignment in June. The case was delayed getting to the grand jury due to COVID-19 restrictions that had closed the courts, Flynn said.

Joseph Latona, the attorney for Torgalski, told ABC News they were “obviously very pleased” by the grand jury’s decision.

“We feel they made the right decision,” he said. “And obviously it was their decision to make.”

Thomas Burton, the attorney for McCabe, told ABC News they are focused on getting the officers “back in the saddle where they belong.”

“Nobody wanted to see Mr. Gugino get hurt, but this did not happen because these two cops sought out to hurt anyone,” Burton said. “The bottom line is, there’s nothing malevolent here.”

Both officers remain suspended pending the outcome of an internal affairs investigation. It is unclear at this point when that will be completed, Buffalo Police Department Captain Jeff Rinaldo told ABC News Thursday.

The Buffalo police union issued a statement in support of the officers following the grand jury’s decision.

“As we have stated all along, Officers McCabe and Torgalski were simply following departmental procedures and the directives of their superiors to clear Niagara Square despite working under extremely challenging circumstances.”

Gugino was among fewer than 20 demonstrators protesting against the death of George Floyd in Minnesota while in police custody. The protest occurred after a Buffalo curfew, Flynn noted.

“There was a curfew, and he broke the law,” Flynn said. “He should not have been shoved. He should have been arrested peacefully.”

QB Matthew Stafford pledges $1 million to build education center in Detroit

(DETROIT) — Los Angeles Rams quarterback Matthew Stafford and his wife, Kelly, are pledging $1 million to build an education center in Detroit’s Lipke Park.

Stafford’s wife announced the pledge in a post on Instagram.

“It has been our goal to always give back to the city. Detroit and its people have blessed us in so many ways, we only hope you have felt our gratitude through our joy of giving back to the city,” she wrote in the post. “As we sat down and tried to figure out how to thank you one last time, we felt like words were not sufficient. And so, we have teamed up with Mitch Albom to create an education center that will be attached to the SAY PLAY Center where Stafford Field is also located.”

According to the SAY Detroit website, the proposed 20,000 square foot facility will include classrooms, labs, and an auditorium.

Stafford spent more than a decade playing football in Detroit, leading the team for 12 seasons, before he was traded to the Rams in exchange for quarterback Jared Goff and three draft picks.

"It's changed my life": Kristen Wiig reveals she's married; talks work and family life during the pandemic

ABC/Rick Rowell(LOS ANGELES) — (NOTE LANGUAGE) Kristen Wiig let slip that she and fiancée Avi Rothman have already tied the knot. 

The SNL vet and Wonder Woman baddie made the revelation on The Howard Stern Show Wednesday.

Wiig revealed married life — and being a mother to her infant twins — has been a bright spot during the pandemic.

“Besides the fact that we are where we are, it’s hard to not feel so much of the s*** and struggle that’s going on, in my home, I’m very lucky about having these two babies and my husband,” the star told Stern.

Wiig said of her family, “They make it all better, and it’s changed my life.” 

The actress admits that while she’s not going “to an actual set,” because of COVID-19 shooting rules, but even taking time to promote her new comedy Barb & Star Go to Vista Del Mar got her homesick.

“[I]t’s really hard because I’m always convinced they’ll forget who I am if I’m gone for a day. I have looked at my children and been like, ‘I am your mother.'”

Wiig’s latest project, the comedy Barb & Star Go to Vista Del Mar, which also stars 50 Shades of Grey‘s Jamie Dornan, debuts in limited theaters and On Demand tomorrow.

Maren Morris is planning a“big, writing, recording trip” with her husband + baby to work on album number three

ABC/Image Group LANow that she’s officially cancelled her tour plans for 2021, Maren Morris says she’s excited to focus on new music.

“I ended up just going ahead and canceling my tour for the year, because it was just getting rerouted and rerouted, and I just felt weird having bands’ money hanging in the balance for that long,” the singer explained during a recent appearance alongside her husband, fellow performer Ryan Hurd, on Apple Music Country.

Though her tour schedule is stalled for the foreseeable future, Maren says that she’s in a creative headspace, and writing for album number three is proceeding full steam ahead. “So I’m actually about to start recording. Ryan and I are about to go on a big writing, recording trip together,” she explains.

It’ll be a new experience for the “Girl” star, who’s used to a routine that involves a lot of travel and performing live show after live show. Maren says that it’ll be her first time making a destination record.

“I’ve never gotten away to write. This is the first time we’re going away to do something creative,” she says. “We’re bringing our baby with us and that’s kind of it.”

The couple welcomed their first child, baby Hayes, in March of last year. Before the COVID-19 pandemic hit, they were planning to take him out on tour in the summer of 2020. Staying at home with her new family has been one unexpected silver lining of a turbulent time, Maren says.

“We’re also getting a ton of time home with our baby, and he’s about to have his first birthday in a couple of months. So that’s crazy,” she adds.

Maren and Ryan will release their first-ever duet, “Chasing After You,” Friday morning.

Carly Pearce, Lauren Alaina announced as special guests for Lindsay Ell’s #LiveRedesigned show

Courtesy of Penelope PRThis Friday, Lindsay Ell will take the virtual stage to perform the songs off her 2020 album, heart theory, for the first time in a full-band, full-production setting.

Since she first announced the #LiveRedesigned event, which supports Crew Nation and other charities to help live music professionals affected by the pandemic, Lindsay has been promising that the show will feature a number of special moments. Now, she’s revealing that some of those special moments will come in the form of guest appearances from Carly Pearce and Lauren Alaina, two of Lindsay’s fellow country stars and real-life friends.

Lindsay’s band and crew will be paid in full for their work on the show, which is employing over 250 people. However, all the companies involved in staging the event are donating their time and supplies, to provide as much money as possible for the charities giving back to music industry professionals whose livelihoods are impacted by the absence of touring.

The show kicks off tomorrow night at 8PM CT.  Tickets are priced on a pay-what-you-can model beginning at $7.
